A Florida couple found guilty Monday of having sex on a public beach could face up to 15 years in prison for the crime. Jose Caballero, 40, and Elissa Alvarez, 20, were convicted of two counts each of lewd and lascivious behavior for having sex on Bradenton Beach in Witnesses said the incident was seen by a 3-year-old and other children, the Miami Herald reports. Lewd conduct crimes are prosecuted more severely in Florida if minors are present, and both Caballero and Alvarez will be required to register as sex offenders. Caballero is likely to serve a full year sentence because he was in jail on a felony cocaine trafficking charge within the last three years, Assistant State Attorney Anthony Defonseca told the Miami Herald. Alvarez, who has no prior convictions, is expected to receive a significantly lighter sentence.

A jury found Elissa Alvarez, 20, and Jose Caballero, 40, guilty of lewd and lascivious behavior in the presence of a minor for having sex on Brandenton Beach in Florida, the Miami Herald reports. It took the jury just 15 minutes to come to the verdict. The couple was caught on camera having sex in broad daylight. Witnesses testified that a 3-year-old girl saw them doing it. As part of their punishment, Caballero and Alvarez will have to register as lifetime sex offenders in the state of Florida, ABC 7 reports. Florida seems to be the only state where getting caught having sex on the beach can lead to having to register as a sex offender, but in South Carolina it is illegal to fall asleep on the beach, which one might do after having sex there.

Jose Caballero, 40, and Elissa Alvarez, 21, were found guilty in May of two counts of lewd and lascivious behavior in a case that drew international attention for the couple's crude act. The amorous pair were videotaped having intercourse on a Manatee County beach last summer in broad daylight. Witnesses testified that a 3-year-old girl saw them.
A man convicted of having sex on a public beach in Florida in front of a child was sentenced on Monday to two and a half years in prison, a state prosecutor said. Jose Caballero, 40, was arrested in Bradenton Beach in west-central Florida last July after other beachgoers complained that he was fondling and starting to have sexual intercourse with a woman on the beach in the middle of the afternoon. A four-year-old child saw the activity, which was videotaped by a witness, a police report said. When her mother asked him to stop, Caballero responded confrontationally, which factored into the sentence requested, said assistant state attorney Anthony Dafonseca.
